THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CIVIL REVISION PETITION No.2164 of 2018 ORDER:
1) Assailing the order dated 27.03.2018 passed in E.A.No.99 of 2018 in E.A.No.100 of 2013 in E.P.No.37 of 2010 in O.S.No.43 of 1988, on the file of the Junior Civil Judge, Anaparthi, wherein the trial Court dismissed the petition filed under Order XXI Rule 26 of C.P.C., the present Civil Revision Petition came to be filed under Section 115 of C.P.C.
2) As seen from the record, the petitioner herein filed claimpetition vide E.A.No.100 of 2018, which was dismissed on 23.03.2018. It appears to be that though the order in E.A.No.100 of 2018 came to be passed on 23.03.2018, certified copy of the same was not furnished. It is said that without furnishing a copy of the order, the trial Court is proceeding to deliver the property. It is now brought to the notice that the copy of the order was made ready by Yesterday evening.
3) Having regard to the above, the present Civil Revision Petition is disposed of, giving liberty to the petitioner to avail the remedy available under law, more particularly by filing an appeal. At this stage, learned counsel for the petitioner would submit that the order in E.P.No.37 of 2010 may be stayed for a period of one week, enabling the petitioner to file an appeal. Hence, the order in E.P.No.37 of 2010 is stayed for a period of one week from
today, enabling the petitioner to avail the remedy, if any, available under law. It is made clear that no further extensions will be granted.
4) There shall be no order as to costs. As a sequel thereto, Miscellaneous Petitions pending if any, shall stand closed. _________________________ JUSTICE C.PRAVEEN KUMAR 11.04.2018 Note: Issue C.C. tomorrow.
