THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.16999 of 2015 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioner states that he is the owner of a vehicle bearing No.AP 10 AU 0159 and it was seized on 17.02.2015 by the fourth respondent on the ground that timber was being smuggled. The vehicle was produced before the fifth respondent. The fourth respondent arrested the petitioner and registered a case in POR No.4059 of 2015. The grievance of the petitioner is that the said vehicle is not being released, as the respondents did not produce the same before the competent Court.

Learned Counsel for the petitioner submits that even though the petitioner filed an application before the Judicial First Class Magistrate, Mulug, no orders have been passed.

In the circumstances, this Writ Petition is disposed of directing the fifth respondent to produce the vehicle before the concerned Court in order to enable the petitioner to file appropriate application for release of the vehicle. The vehicle shall be produced before the concerned Court within a period of one week from the date of receipt of a copy of this order. The Writ Petition is disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J)
