Smt Shaila, Hyderabad v. Pyarelal Jaiswal, Hyderabad
THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CIVIL REVISION PETITION No.3796 of 2015 ORDER:
Today also, there is no representation for the revision petitioner. When the matter was listed on 13.03.2018, since there was no representation for the revision petitioner, the Registry was directed to list the present revision petition under the caption 'for dismissal'. But, somehow, the Registry has not followed the said order and listed under the caption 'for admission'.
Even otherwise, Sri Mirza Sibtine Raza, learned counsel for the respondent, would submit that the appeal suit in A.S.No.153 of 2015 preferred by the revision petitioner against the decree and judgment, dated 22.01.2015, in O.S.No.1483 of 2012 on the file of XXI Junior Civil Judge, City Civil Court, Hyderabad, was dismissed on 30.01.2017 by the XXV Additional Chief Judge, City Civil Court, Hyderabad, and the present revision petition is filed by the revision petitioner on the main ground that there is likelihood of her success in the appeal preferred by her. Learned counsel has also filed a memo along with a copy of the judgment in A.S.No.153 of 2015 passed on 31.01.2017, which reflects that the appeal preferred by the revision petitioner was dismissed.
Hence, the present Civil Revision Petition is dismissed as infructuous.
Miscellaneous Petitions, if any, pending in the present revision, stand closed. No order as to costs.
