THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CMA No.939 OF 2005 JUDGMENT:

1 This Civil Miscellaneous Appeal is filed under Section 75 of the Provincial Insolvency Act, challenging the judgment and decree dated 29.07.2005 passed by the learned VII Additional District Judge (FTC) Visakhapatnam in I.P.No.6 of 2002.

2 When the matter is taken up for hearing, the learned counsel for the appellant sought permission of this Court to permit the appellant to withdraw this Civil Miscellaneous Appeal with a liberty to the appellant to avail the remedies available to him under law including claiming of preferential right over the other creditors before the official receiver. Permission is accorded. 3 In the result, the Civil Miscellaneous Appeal is dismissed as withdrawn giving liberty to the appellant as prayed for. As a sequel, the miscellaneous petitions, pending in this petition, if any, shall stand closed.
