This petition is filed seeking to quash all further proceedings in C.C.No.267 of 2017 on the file of the III Additional Judicial Magistrate of First Class, Ongole, on the ground that the petitioners, who are accused Nos.2 to 4 in the case, are innocent and hence, continuation of proceedings against them would be an abuse of process of Court. 2.
A perusal of the statement of the complainant would show that allegations are nevertheless made against the petitioners, though they are not very specific. Since allegations are there against the petitioners, it is not advisable to quash the proceedings against them. 3.
But, however, the contention of the learned counsel for the petitioners that the petitioners are having difficulty in attending the Court, can be taken care of by directing the Court below not to insist the presence of the petitioners till the discharge petition filed by them is disposed of and the petitioners are at liberty to file a discharge petition before the Court below not later than two weeks. It such petition is not filed, the Court below shall go on with the proceedings as usual. 4.
