THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.41169 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner's grievance is that respondents 2 and 3 are not entertaining the document presented by him for registration with regard to the land admeasuring Ac.0.061⁄2 cents in Plot No.48 in Survey No.7A of Pandipadu Village Fields, Pandipadu Panchayat, Kurnool Sub-Division, Kurnool District.

It is well settled that even before presentation of a document, registering authority cannot refuse or reject the document and in matters of this nature, this Court has been directing the Registrar to receive and process the document in accordance with law on examining the same under the Indian Stamp Act and the Indian Registration Act.

Liberty is also left to respondents 2 and 3 that if they are not satisfied with registering of the document, they shall pass appropriate reasoned order under Section 71 of the Indian Registration Act. The Writ Petition is, therefore, disposed of directing respondents 2 and 3 to receive and process the document presented by the petitioner relating to the aforesaid land and thereafter take appropriate steps as indicated above. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
