Learned counsel appearing for petitioner submits that even though in the year 2011 District Collector passed orders for deleting the land in Sy.Nos.153/1, 153/3 and 154/1 from the list of prohibited properties to an extent of Ac.9.76 cents, fresh notification was issued under Section 22-A of Registration Act including the land to an extent of Ac.5.00 cents in Sy.No.153 in the list of prohibited properties and on the premise, deed of conveyance presented by the petitioner was not processed. Having come to know of such wrong inclusion on 19.02.2018, representation was made to the District Collector requesting to delete the land to an extent of Ac.5.00 cents in Sy.No.153 from the list of prohibited properties. According to learned counsel, Tahsildar has also submitted a report giving status report of the earlier proceedings and the status of the land. But, so far no decision is made. On account of delay in taking a decision by the District Collector, grave prejudice would be caused to the petitioner. Representation is enclosed at page no.123 of writ paper book.

Since petitioner has submitted representation to the District Collector in accordance with the law laid down by the Full Bench of this Court Vinjamuri Rajagopala Chary v. State of Andhra Pradesh and others1, without expressing any opinion on merits, Writ Petition is disposed of, directing the District Collector, 1 2016 (2) ALD 236 (FB)

Visakhapatnam District to examine the claim of petitioner for deletion of property to an extent of Ac.5.00 in Sy.No.153 of Paradesipalem village, Visakhapatnam Rural Mandal, Visakhapatnam district from the list of prohibited properties under Section 22-A of the Act and pass appropriate orders as warranted by law assigning due reasons in support of its decision and also duly taking note of earlier report of the District Collector deleting the land in Sy.Nos.153/1 and 153/3, within a period of six weeks from the date of receipt of copy of this order. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
