THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI Writ Petition No.11122 of 2018 ORDER:

This writ petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking verbatim the following relief: " For the reasons stated in the accompanying affidavit, the petitioner herein pray that this Hon'ble Court may be pleased to issue writ, order or direction, more particularly one in the nature of writ of mandamus declaring the observation of the 2nd respondent in letter reference no. NA (G48988) dt.26-03-2018 insisting the petitioner to submit the land documents for establishment of LPG godown other than lease agreement of the site as illegal, arbitrary and violative of principles of natural justice consequently directing the respondent no.2 to accept the lease agreement submitted by the petitioner for approval of construction of the LPG cylinders storage godown at the plot in Sy.No.844/1A2 of Mandapeta Town, East Godavari District and pass any other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." 2.

When the writ petition is taken up for consideration, learned counsel representing Sri T.V.S.Prabhakar Rao, learned counsel appearing for the petitioner, would submit that the 3rd respondent is willing to issue necessary orders/ proceedings in favour of the petitioner, and that, therefore, no orders are required to be passed in the writ petition. So saying, he sought permission to withdraw the writ petition.

Permission, as sought for, is accorded.

Accordingly, the writ petition is dismissed as withdrawn. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
