THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.37072 of 2015 ORDER:
The prayer of the petitioner, appearing as a party-in-person, is in the following terms:
"For the reasons stated above it is prayed that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS direct the 1st respondent and 2nd respondent to permit the petitioner to attend to his M.Th classes and permit to write M.Th examinations conducting by Senate of serampore College or Serampore College (both are same) inside the West Bengal jurisdiction, herein 1st respondent wilfully violated this Hon'ble High Court's order dated 16.09.2015 in W.P.M.P.No.35673 of 2015 in W.P.No.25977 of 2015, and pass such other order or orders as may deem fit and proper in the circumstances of the case."
As it is not stated in the prayer as to where the petitioner/party-in-person seeks to pursue his M.Th classes and write his exams, this Court put a question to him and he fairly stated that he wishes to do so in the State of West Bengal. If that be so, this Court has no territorial jurisdiction to entertain this writ petition. The writ petition is accordingly dismissed on this short ground. This order shall not preclude the petitioner/ party-in-person from approaching the appropriate Court for relief, if so advised. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
