THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.29278 OF 2015 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

The petitioners seek correction of mutation of entries in the record of rights on the ground that they were never given notice before deleting their names and inclusion of the names of the contesting respondents.

The petitioners have, however, not made any application before the recording authority and as such a mandamus cannot be sought by directly approaching this Court. If the petitioners claim infringement of their rights, they are at liberty to make appropriate application before the recording authority and if such an application is filed, the recording authority shall examine the same on its own merits and pass appropriate orders in accordance with law.

With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
