ORAL ORDER:

Having regard to the averments made in paragraph 3 of the counter affidavit, learned counsel for petitioner, fairly submitted that contempt case can be closed.

In paragraph 3 of the counter affidavit, respondents have stated as under: ".........It is respectfully submitted that in view of the interim directions dated 4.9.2013 of the Hon'ble High Court in WPMP No. 30572 of 2013 in WP No. 24799 of 2013, the petitioner ceases for appointment by transfer is considered and speaking orders were issued to the petitioners herein vide Lr No.

SE/OP/NZB /DE(T)/PO/JAO/ADM/C1/D No. 4333 to 4338/13 dated 13.3.2014 explaining the circumstances under which their request for was not considered for appointment by transfer as Sub Engineers and same were communicated to the petitioners and also filed WVMP No. 1221 of 2014 against the interim order in WP No. 24799 of 2013 and the same was pending at Hon'ble High Court.

Having regard to the statement made by the respondents, it cannot be said that respondents have willfully and deliberately violated the orders of this Court and more over, it is an ex-parte orders and respondents have also filed a vacate stay petition in WVMP No. 1221 of 2014. Accordingly, the contempt case is closed. Liberty is granted to the petitioner to challenge the order passed by the respondents consequent to interim order. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
