HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.1830 OF 2017 O R D E R :
This contempt case is filed alleging violation of the order dated 20.03.2017 passed by this Court in WP.No.9699 of 2017 wherein this Court directed the 4th respondent-Tahasildar therein to consider and dispose of the application of the petitioner dated 21.10.2016 stated to have been submitted in Form 6A as per Rule 18 and Section 4(1) of the A.P.Rights in Land and Pattadar Pass Books Act, 1971, for mutation of their names in the revenue records and for issuance of pattadar pass books and title deeds. The respondent filed counter stating that petitioner's application is rejected vide Endorsement dated 12.06.2017 by holding as follows;
" ..... you are informed that your application dated 21.10.2016 is not in Form VI A as noted in the order of the Honourable High Court, the application sent by you is for corrections in Adangal. It was rejected. So, you are required to send your application in Form VI A, noting the correct Survey Number and enclosing the relevant documents to show how you acquired the land as per Sec.4(1) to take further action in the matter." Learned counsel for the petitioner states that the petitioner will make necessary application in Form VI A along with relevant documents and seeks liberty to file fresh application.
In view of the above, I do not see any violation of the orders passed by this Court. However, it is open for the petitioner to make necessary application in Form VI A as suggested by the respondent in the Endorsement dated 12.06.2017, and on such application being filed by the petitioner, the respondent shall consider the same and pass orders.
Subject to above observation the Contempt Case is dismissed. No order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the contempt case, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 07.02.2018 t k
