THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 35374 of 2014 ORDER:
This Writ Petition is filed for the following relief: "...to issue direction more particularly in the nature of Writ of Mandamus declaring the action of the Third respondent by calling the Petitioners No.1 and 2 to the Police station without any due process of law is arbitrary illegal and in violation of principles of natural justice and fundamental rights and consequentially direct the Third respondent not to harass the Petitioner No.1 and 2 by calling them to Police station in the name of enquiry." A counter-affidavit is filed by the third respondent - Station House Officer, Raidurgam Police Station, Cyberabad, Hyderabad, asserting that as a matter of fact, there is no crime registered against petitioners, as such, the question of calling them to the Police Station does not arise and that the allegations of the petitioners are false.
Learned counsel for the fourth respondent submits that there are various commissions and omissions on the part of the petitioners in addition to violation of municipal laws by constructing cellar + 5 floors and various other writ petitions are also pending.
The limited scope of this Writ Petition is with respect to the allegation of the petitioners that the third respondent is calling
CKR, J W.P.No.35374 of 2014 them to the Police Station without any reason. However, the said aspect is denied by the third respondent in the counter-affidavit. In those circumstances, without expressing any opinion on merits of the matter, this Writ Petition is closed. Miscellaneous applications, if any pending, shall also stand closed. There shall be no order as to costs.
