Petitioner is working in the Department of Public Health of the 2nd respondent as a Public Health Nurse(PHN) and she was eligible and qualified for promotion to the post of Community Health Officer in the year 2013, but she relinquished her right to promotion at that time due to her personal problems and due to ill-health of her husband, who died on 13.01.2016. 2.

Petitioner contends that the respondents are again contemplating to make promotions to the said post and she had given a representation on 17.09.2016 to the 1st respondent stating that her case be considered for promotion this time to the post of Community Health Officer, without reference to her earlier relinquishment for promotion in 2013, and the 1st respondent has not taken any action thereon.

The Government Pleader for Services appearing for respondents states that the 1st respondent will consider the said representation for promotion to the post of Community Health Officer in the next panel without reference to the petitioner's earlier relinquishment in 2013.

In view of the said submission, this Writ Petition is disposed of directing the 1st respondent to consider the petitioner's representation for promotion to the post of Community Health Officer in the next panel, in accordance with

law, without reference to the petitioner's earlier relinquishment in 2013. There shall be no order as to costs. 5.

Consequently, miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
