This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused, for grant of anticipatory bail in Crime No.52 of 2019 of Marriguda Police Station, Nalgonda District, registered for the offences punishable under Sections 376, 420 and 417 of IPC.

Heard learned counsel for the petitioner/ accused, learned Additional Public Prosecutor representing the respondent/ State and perused the record.

Learned counsel for the petitioner would submit that the allegations levelled against the petitioner/ accused are all false and there is no iota of evidence against the petitioner. Hence, he prayed to grant anticipatory bail to the petitioner.

Learned Additional Public Prosecutor representing the respondent-State opposed to grant bail to the petitioner. 5.

As seen from the FIR, specific allegations are levelled against the petitioner that on the pretext of marriage, he sexually enjoyed the de facto complainant since 2017 whenever he came to India and lastly in the year 2019 when the de facto complainant asked the petitioner to marry her, he refused to marry saying that if he marries her, his parents will die.

Having regard to the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner. 7.
