THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.3446 OF 2022 ORDER:- This petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioners, who are arrayed as Accused Nos.2 and 3, in the event of their arrest in connection with Crime No.99 of 2022 of P.S.Paloncha Town, registered for the offences punishable under Sections 304-B, 498-A of Indian Penal Code read with Section 3 and 4 of Dowry Prohibition Act, 1961. 2.

Heard the learned Counsel appearing for the petitioners and learned Assistant Public Prosecutorrespondent, for the State. 3.

The petitioners, who are Accused No.2 and 3, are the parents of the accused No.1. The allegation against Accused No.1 to 3 is that, the deceased, who was the wife of the Accused No.1, was married on 7.10.2020, dowry was given, thereafter accused No.1 started

demanding additional dowry. Though, initially the 1st accused and the deceased were staying with these petitioners, it is stated that, prior to three months of the death of the deceased, she was staying in the house of her brother, where she committed suicide. Since no specific allegations are made against these petitioners, the petitioners, who are aged people, can be granted the relief of anticipatory bail.

The Criminal Petition is, accordingly, allowed and the petitioners 1 and 2/Accused No.2 and 3 are granted anticipatory bail subject to the following conditions:

(1) The petitioners 1 and 2/Accused No.2 and 3, are directed to surrender before the Station House Officer, Paloncha, within ten days from the date of this order, and, on such surrender, the petitioners are directed to be released on bail on their executing a personal bond to the tune of Rs.20,000/- (Rupees twenty thousand only) with two sureties to the like sum each to his satisfaction.

(2) The petitioners shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case as and when required.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
