THE HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.13478 of 2019 ORDER:

Learned Standing Counsel for the 2nd respondent Bank submits that the 2nd respondent Bank has to act on the instructions of the 1st respondent and that the 1st respondent has passed an order on 04.05.2016 stating that the petitioner is entitled for family pension with effect from 27.04.2016 and since then they have been paying the pension, as such, the 2nd respondent bank cannot be faulted. Learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition with liberty to challenge the said order, dated 04.05.2016.

Permission as sought for is accorded.

Accordingly, the writ petition is dismissed as withdrawn with liberty to challenge the order, dated 04.05.2016. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
