HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13476 OF 2019 ORDER:

This writ petition is filed aggrieved by inaction of respondentpolice in registering crime on the complaints lodged by petitioner dated 05-03-2019 and 10-06-2019 against unofficial respondents. Learned Assistant Government Pleader for Home produced written instructions, which reads as under:

"It is respectfully submitted that the petitioner Mohd.Riyaz sent a complaint to the Commissioner of Police through registered post on 5.3.2019, wherein he stated that his Fortune Car B.No.TS 09 FA 5800 was taken away by M/s.Fortune in collusion with Faisal Bin Saleh Jabri @ Faisal Jabri and wrongfully confined the said vehicle with them and causing wrongful loss to them.

That on perusal of the above complaint, it was disclosed that already a case was registered against the petitioner Mohd.Riyaz and his family members in Crime No.333 of 2018, U/s.406, 420, 506 r/w.34 IPC of Panjagutta police station on 23.07.2018 basing on the complaint of Mohd. Abdul Nadeem to invest money and get profits and that he offered to pay him monthly dividend Rs.1.lakh investment, basing on which he took money but failed to return it. It is submitted that in the above case Crime No.333/2018 XIV Addl.Chief Metropolitan Magistrate, Hyderabad issued orders to hand over the case property i.e. Toyota Fortune Car B.No.TS 09 FA 5800 to Fortune Integrated Assets Finance Limited and Ajay Auto Finance, as such she was handed over to them and obtained acknowledgment. As such no further enquiry and action on the complaint of the petitioner was taken as the vehicle was received by the Fortune Integrated Assets Finance Limited and Ajay Auto Finance.

It is submitted that a copy of Notice was sent to the petitioner through registered post on 6.7.2019 informing above said facts."

Recording the same, the writ petition is disposed of. If still the petitioner has any grievance, he can avail remedies available to him under law.
