HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 17467 of 2005 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.3 in not completing the enquiry within the time frame and not issuing pattadar passbooks and title deeds in spite of a direction to that effect by proceedings dated 04.12.2003 in Ref.No.LRDT/ 888/ 2003 issued by respondent No.2 is illegal, irregular, arbitrary and contrary to the provisions of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971; and consequently direct respondent No.3 to complete the enquiry and issue pattadar pass book and title deed in compliance with the order dated 04.12.2003.

2) Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to respondent No.3 to conduct denova enquiry as directed by respondent No.2 at the earliest.

3) Learned Government Pleader for Revenue would submit that fresh enquiry may be ordered, provided the enquiry is still pending. He however, submits that in case if the enquiry is to be conducted, the Mandal Revenue Officer may be directed to take into consideration the present status of land and also give liberty to the authorities to produce all the relevant papers.

4) Having regard to the facts and circumstances of the case, the writ petition is disposed of, directing the Mandal Revenue Officer to conduct a enquiry, if not already conducted, after giving liberty to the petitioner and the respondents herein, to place all the records and also by taking into consideration the present status of land and pass orders, in accordance with law, as early as possible, preferably, within a period of eight (08) weeks from today.

5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
