THE HONOURABLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No.5814 of 2025 ORDER:

This Criminal Petition is filed under Sections 484, 483(1)(2) of Bharatiya Nagarik Suraksha Sanhitha, 2023 (for short 'BNSS') seeking to reduce the surety amoun imposed on the petitioner/accused No.2 in Criminal Miscellaneous No.1254 of 2025, dated 24.03.2025 in Crime No.16 of 2025 on the file of the P.S. Excise Station Ameerpet, Hyderabad for the offences punishable under Section 8(C) read with 20(b)(ii)(B) of Narcotic Drugs and Psychotropic Substances Act, 1985 by the learned Sessions Judge, Hyderabad.

Heard Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for the respondent/State. 4.

After perusal of the petition, the petitioner pleaded that the petitioner approached the learned Sessions Judge, Hyderabad and filed Criminal Miscellaneous Petition

No.1254 of 2025 in Crime No.16 of 2025 for grant of regular bail. The learned Session Judge, Hyderabad allowed the said petition and granted bail on executing a personal bond for a sum of Rs.25,000/- with two sureties each for a like sum to the satisfaction of the said Court. The petitioner further pleaded that due to his poor financial condition the petitioner could not execute the personal bond for a sum of Rs.25,000/- and the petitioner is still in judicial custody and if the surety amount is not reduced, the petitioner will be put to great hardship and requested to reduce the surety amount.

Learned Additional Public Prosecutor has not opposed the same.

Taking into consideration, the facts and circumstances of the case and submissions made by the respective parties, this Court is inclined to modify the condition of executing a personal bond for Rs.25,000/- to executing a personal bond of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Sessions Judge, Hyderabad.

Accordingly, Criminal Petition is allowed and the petitioner shall be enlarged on bail subject to the petitioner executing a personal bond for Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum of each to the satisfaction of the Court below and other conditions imposed by the Court below remains unaltered. Miscellaneous applications, pending if any, shall stand closed.
