HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 13257 OF 2005 ORDER :

When the matter is taken up for hearing, the learned Counsel for the petitioner submits that the petitioner was appointed as an Attender and the Trust Board has recommended the case for grant of regular Pay Scale and the said proposals were also forwarded to the Assistant Commissioner of Endowments and the Assistant Commissioner of Endowments had also submitted proposals to extend regular Pay Scale to the petitioner and, while matters stood thus, the respondents were trying to disengage the services of the petitioner. In those set of circumstances, the petitioner has filed this Writ Petition and this Hon'ble Court, vide orders dated 22.6.2005, was pleased to grant interim directions to continue the petitioner as Attender.

By virtue of the said interim orders, the petitioner is being continued in service and contends that appropriate orders be passed directing the respondents to extend regular Pay Scale attached to the post of Attender. The learned Standing Counsel Sri Srikanth Reddy, appearing for the 3rd respondent, had submitted that in pursuance of the interim orders passed by this Hon'ble Court, the petitioner was continued in service. Presently, the petitioner is not attending the duties on his own and contends that the Writ Petition is liable to be dismissed as there are merits in the Writ Petition.

the petitioner is given liberty to submit a fresh representation to the respondents seeking regular Pay Scale attached to the post of Attender within a period of two weeks from the date of receipt of a copy of this order and upon such representation being received, the respondents shall consider and pass appropriate orders by duly taking into account earlier Trust Board recommendation and also Assistant Commissioner of Endowments recommending the case of the petitioner for grant of pay scale to the petitioner, within a period of four weeks thereafter. With this observation, Writ Petition is disposed of. Miscellaneous Petitions pending, if any, shall stand closed. ___ _________________________ ABHINAND KUMAR SHAVILI, J 21st December, 2018 GS.
