HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3982 of 2018 ORDER:

This petition is filed under Section 482 Cr.P.C by the petitioners/A1, A3 & A4 seeking to quash the proceedings against them in Crime No.184 of 2017 on the file of Kakinada III Town PS, East Godavari District, registered for the offences under Sections 420, 500 r/w 34 IPC and 156 (3) Cr.P.C.

2) Having regard to the submissions of the learned Additional Public Prosecutor that the investigation is in the nascent stage, it is not apt to quash the proceedings. Therefore, the investigation must lead to logical conclusion. However, having regard to the nature of accusation, this Court is of the considered view that the Investigating Officer shall strictly follow the guidelines rendered by the Hon'ble Apex Court in the decision of Arnesh Kumar v. State of Bihar1 and also the procedure contemplated under Section 41-A Cr.P.C. towards the petitioners during the course of investigation. The petitioners in their turn shall cooperate with the Investigating Agency for smooth completion of investigation. 3) Accordingly, the Criminal Petition is disposed of. As a sequel, miscellaneous applications, pending if any, shall stand closed.
