HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.18015 OF 2017 ORDER:

This writ petition is filed seeking to direct the respondents to consider the representations of the petitioner dated 11.5.2011, 15.2.2012 and 30.5.2017 for release of deposits and centering charges payable to the petitioner.

The case of the petitioner is as follows:

The petitioner is executing various civil works awarded by the Government and its instrumentalities for the last several years. The 2nd respondent sanctioned work "widening of existing road from 4 lane to 6 lane from Ramanujam circle to Tiruchanoor" vide agreement dated 3.2.2009. The petitioner completed the work within the stipulated time. The petitioner made representation for payment of bills, which are pending since May, 2011. The final bills are prepared by the Department proposing the deduction of huge amount towards centering charges in the pavement concrete item on the ground that the rate adopted in the estimate is wrong. In that regard, the petitioner made several representations to the respondents. But the respondents did not consider his representations and kept pending without passing any orders.

Heard and perused the material available on record. 4.

The main grievance of the petitioner is that he made several representations to the respondents for release of deposits and centering charges withheld in the final bills payable to the petitioner. But they have not passed any orders so far.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order: "The respondents are directed to consider the representations made by the petitioner and pass appropriate orders, in accordance with the terms and conditions of the agreement, within a period of three months from the date of receipt of a copy of this order." 6.
