THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.33803 OF 2015 ORDER:

The petitioner was elected as a President of 4th respondent' society on 20-09-2010 and officiated as such till 19-09-2015, on which date the tenure of the Managing Committee of the society came to an end. The petitioner states that on 02-08-2015 when the Managing Committee was in office, the 4th respondent passed a resolution electing the President as a Delegate to represent the 2nd respondent bank. He attended the meetings of the 2nd respondent bank as a Delegate of the 4th respondent till 01-08-2015. After tenure of the Managing Committee on 19-09-2015, he was not allowed to attend the meetings of the 2nd respondent bank. In those circumstances, the present writ petition is filed seeking a direction to allow him to participate in the proceedings of the 2nd respondent bank as a Delegate of the 4th respondent.

Learned counsel appearing for the petitioner submits that post of Delegate is an elected post and it will not come to an end automatically by cessation of the membership of the Managing Committee of the 4th respondent. He further submits that the term of Delegate is co-extensive to the term of the 2nd respondent bank.

3. I am not in agreement with the said proposition because when the petitioner ceased to be a member of the Managing Committee, he automatically ceased to be a Delegate of the 4th respondent.

4. Learned counsel for the 2nd respondent submits that a person in charge was appointed to the 4th respondent and he is representing the affairs of the 4th respondent.

5. In that view of the matter, the present writ petition is not maintainable and accordingly, it is dismissed at the stage of admission. No order as to

costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
