THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.11331 OF 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed requesting to declare the inaction of respondents in completing investigation in Crime No.855 of 2013 on the file of Krishna Lanka Police Station, Vijayawada, and failure to file a final report by following the procedure established by law, as illegal and arbitrary. 2.

I have heard the submissions of Sri S.S. Prasad, learned Senior Counsel appearing for the petitioner, and of the learned Government Pleader for Home (AP) appearing for respondent Nos.1 to 4.

I have perused the material record.

Learned Senior Counsel appearing for the petitioner would submit that on a complaint given by the brother-in-law of the petitioner herein, a crime was registered and that investigation into that crime was completed and charge sheet was also filed by the Station House Officer, Bhavanipuram Police Station, Vijayawada City, and that pursuant to that said charge sheet, C.C.No.440 of 2016 was taken on file by the Court of the Chief Metropolitan Magistrate, Vijayawada City, and in that view of the matter, necessary directions may be given to the police officer concerned to complete investigation expeditiously in the instant crime and do the needful in the matter in accordance with law. 4.

Learned Government Pleader for Home (AP) does not dispute the said submissions, while endorsing the submission of the learned Senior Counsel as regards expediting investigation into the instant crime.

Recording the submissions, the Writ Petition is disposed of directing the Station House Officer, Krishna Lanka Police Station, Vijayawada, to expedite investigation into the case in Crime No.855 of 2013 on the file of said police station and file a final report before the Court of learned Magistrate concerned by strict adherence to the procedure established by law.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.

There shall be no order as to costs.
