Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
The petitioner alleges that respondents 3 and 4 are dealing with his land without any authority. The expression "dealing with the land" is itself inexplicable. The averments in the affidavit however show that there is alleged interference and attempt to encroach the land for the purpose of converting into burial ground.
The petitioner claims to be the lawful owner of Ac.1.13 cents in Survey Nos.244 and 258 of Lankelakurapadu Village, Muppala Mandal, Guntur District. Alleging that the respondent authorities are not following due procedure, the present Writ Petition is filed. Learned Government Pleader for Revenue has received instructions from the Tahsildar, Muppala Revenue Village and Mandal, Guntur District, the 3rd respondent, which state that a survey was conducted for the purpose of burial ground situated in Survey No.258 of Lankelakurapadu Village and for the purpose of demarcation, bushes were cleared. The said survey is stated to have been conducted by Swargapuri Programme Development Committee and its members were present at that time. Having been received the report from the Mandal Surveyor, no further action is taken by the respondent authorities.
In view of the above, in my view, the Writ Petition appears to have been filed on mere apprehension. Therefore, no further orders are required to be passed in this Writ Petition.
The Writ Petition is accordingly disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
