HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.8131 OF 2017 ORDER:

This writ petition is filed challenging the notice dated 02.01.2017, issued by the 2nd respondent to the petitioner under Rule-3 of the A.P.Assigned Lands (Prohibition of Transfers) Rules, 2007, asking the petitioner to show cause as to why he should not be evicted from the subject lands. Learned counsel for the petitioner submits that in pursuance of the said notice the petitioner submitted explanation dated 28.01.2017 but without passing any final orders on the same, the respondents are trying to evict the petitioner. He also submits that a certificate was also issued to the petitioner on 25.05.2014 by the then Tahasildar confirming that the subject land is not a Government land or Assigned land and the same was also produced before the 2nd respondent.

Heard learned Assistant Government Pleader for Revenue.

In view of the aforesaid facts and circumstances, the 2nd respondent is directed to pass final orders after considering the explanation and affording opportunity of hearing to the petitioner. While passing the final orders the 2nd respondent shall take into consideration the certificate dated 25.05.2014

produced by the petitioner. Till passing of final orders by the 2nd respondent, there shall be interim stay of dispossession. Accordingly, the writ petition is disposed of. No order as to costs.
