The petitioner prayed for withdrawing the suit at appellate stage and also for grant of leave to institute fresh suit. The learned Principal District Judge recorded cogent reasons for not granting liberty to the petitioner to file fresh suit. No error is pointed out warranting interference of this Court under Article 227 of the Constitution of India. Revision fails and is accordingly dismissed. No order as to costs.
