THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.3624 OF 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioner/Accused for grant of anticipatory bail in the event of his arrest in connection with Crime No.75 of 2019 of Rebbena Police Station, KBM-ASF District, registered for the offences punishable under Sections 417, 420 and 376 I.P.C.

Heard learned counsel for the petitioner/Accused, and the learned Additional Public Prosecutor representing the respondentState. Perused the record. 3.

The allegation in the complaint would go to show that the petitioner/accused is residing adjacent to the house of the complainant and he used to come to the house of the complainant now and then; that on that pretext, the accused proposed the complainant, promised to marry her and developed physical relationship with her and thereafter, cheated her. 4.

Learned counsel for the petitioner/accused would submit that the petitioner is innocent of the offences alleged against him and he is falsely implicated in this case; that the petitioner is appointed as Panchayat Secretary of Thiryani Village and his probationary period is also not completed; that even if the allegations made in the complaint are taken at their face value and accepted, no offence is made out against the petitioner and hence, he prays to grant anticipatory bail to the petitioner.

Learned Additional public Prosecutor opposed the grant of the bail to the petitioner/Accused.

As seen from the complaint, there are allegations against the petitioner/accused. Looking into the nature of allegations and the gravity of offence, I am not inclined to grant bail to the petitioner. 7.

Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this petition shall stand closed.
