THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.1301 of 2015 ORDER:

Upon hearing both sides, at the admission stage, the following Order is passed:

Having regard to the prima facie accusation made against the petitioner/accused for the offence under Section 420 IPC to the effect that he deceived the complainant on false pretext of marriage and cohabitated with her for about 13 years, it is not a fit case to quash the proceedings, that too when the investigation is in the mid way. Therefore, the investigation shall continue. However, considering the submission of learned counsel for petitioner that the petitioner/accused is a Government Employee and now working in the Central Bank of India, Ongole, and his arrest may cause hardship to his employment and livelihood, the Police of Cyberabad, Ranga Reddy District, are directed to strictly follow the procedure contemplated under Section 41-A Cr.P.C. towards the petitioner/Accused during the course of investigation. The petitioner shall cooperate with the investigating agency for smooth completion of investigation. Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous petitions, if any, pending shall stand closed.
