THE HON'BLE SRI JUSTICE B. VIJAYSEN REDDY CRIMINAL PETITION No.5463 of 2024 ORDER: (ORAL) This petition is filed, under Section 438 of the Criminal Procedure Code, seeking grant of anticipatory bail to the petitioners, who are A2 to A4, in Cr.No.42 of 2024 registered for the offences punishable under Sections 307, 504, 447, 427 and 506 read with Section 34 of the Indian Penal Code (for short 'IPC') on the file of the Station House Officer, Kandukur Police Station, Rachakonda Commisionerate.

It is alleged in the report lodged by the defacto complainant that he is rearing buffaloes in his agricultural land and selling milk. A1 is acquainted to him for a long time and used to come to his house to purchase milk. Sometimes, he used to send his friend - A2 to purchase milk. While so, A1 found phone number of one woman by name Kalamma and started speaking to her in obscene manner. On knowing about the same, the defacto complainant called A1 and questioned him. Later, A1 called the defacto complainant and threatened him with dire consequences. That, on
the night of 29.02.2024 when the defacto complainant was sleeping in his room, accused persons illegally trespassed into his room by breaking doors and abused him in filthy language and questioned him as to what connection he has with one Kalamma. 3.
It is further alleged that accused came on the motor vehicles with sticks, stones and pounced on the defacto complainant. They beat him with stick on his head, assaulted him and attempted to commit murder. However, he escaped from the scene. 4.

It is clear from the contents of the report lodged by the defacto complainant that there are no allegations of such nature which would attract the offence under Section 307 IPC. It is the case of the defacto complainant that he was injured, however, nothing is spoken about the injuries except vague allegations that he was hit with the stick on his head.

In the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners - A2 to A4.
Hence, the criminal petition is allowed and the petitioners are directed to surrender before the Station House Officer, Kandukur Police Station, Rachakonda Commissionerate, within 15 days from the date of this order. On such surrender, the petitioners shall be released on bail on their executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for a like sum each to the satisfaction of the said Station House Officer. Further, on such release, the petitioners shall abide by the conditions as under:
1. The petitioners shall make themselves available for interrogation by a police officer as and when required.
2. The petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
3. The petitioners shall not leave India without the previous permission of the Court.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
