Order : (Per Hon'ble Sri Justice C.V.Nagarjuna Reddy)

This Contempt Case is filed alleging willful disobedience of Order, dated 03-12-2015, in WP.No.39286 of 2015, by the respondent.

In the aforementioned order, this Court, while disposing of the Writ Petition, placed on record the submission of the learned Standing Counsel for the respondent that if the petitioner's representation was received by the respondent, it will hold an enquiry during which if it was found that the private respondents in the Writ Petition have encroached any part of the public road, it will take appropriate steps for removal of the same. Alleging that the respondent failed to take steps for removal of encroachment contrary to the undertaking given by it to this Court, the writ petitioner filed this Contempt Case.

The respondent has filed counter-affidavit as well as additional counter-affidavit, from a perusal of which this Court is satisfied that it has taken all conceivable steps to act in accordance with the undertaking given by it. However, when demolition notice was given, the private respondents in the Writ Petition have filed WP.No.13155 of 2016 and

secured an interim order of stay on 19-04-2016, thereby, disabling the respondent from proceeding further.

In the aforementioned facts of the case, I am satisfied that the respondent has not violated the order of this Court. Hence, the Contempt Case is dismissed and the respondent is discharged from the Contempt Proceedings.

As a sequel to dismissal of the Contempt Case, Application No.253 of 2016, filed by the petitioner for interim relief, is disposed of as infructuous.
