HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.3552 of 2012 ORDER:

The petitioner prays for the following relief: ".....writ of Mandamus declaring the acts of respondents in seeking to take over petitioner's property bearing M.C.H.No.8-1-303/5 on Plot No.5 in T.S.No.14/1, admeasuring 287 sq. yards, situated at Vivekananda Nagar, Shaikpet Village, Tolichowki, Hyderabad, as illegal, arbitrary and unconstitutional."

2. On 18.07.2016, this court passed the following order. "At request of respondents, the writ petition underwent several adjournments.

The Assistant Government Pleader seeks further time of one week to file counter affidavit. The request for filing counter affidavit is accepted subject to respondents 2 to 4 depositing a sum of Rs.5,000/- (Rupees five thousand only) towards costs to the credit of Secretary, Telangana State Legal Services Authority, Hyderabad.

The Registry is directed to communicate the order to the District Collector/2nd respondent to initiate enquiry for the alleged reasons for not filing counter-affidavit for four years.

Post on 26.07.2016."

3. The 4th respondent complied with the condition and also filed counter-affidavit.

4. Mr. Botla Venakateswara Rao, learned counsel for the petitioner, after taking note of the reply of the respondents, submits that having regard to various proceedings referred by the respondents, the prayer as made in the writ petition is unavailable for consideration. The statement is placed on record.

5. The writ petition is dismissed as without merits. No order as

to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
