HONOURABLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.12228 OF 2007 ORDER:

The grievance of the petitioners in the present writ petition is that though the pattas for the land situated in Sy.No.27 of Kowkour Village, Malkajgiri Mandal, Ranga Reddy District, were given to them in the year 2003, possession of the same was not handed over to them so far.

Counter affidavit has been filed by the 3rd respondentTahsildar stating inter alia that though the office of the Mandal Revenue Officer, Malkajgiri issued house site patta certificates to the petitioners in respect of the land in Sy.No.27 of Kowkur Village in the year 2003, as there is a ban imposed by the Government, vide G.O.Ms.No.493, dated 28.04.2006, on the assignment of Government land for individual house sites in the urban area of Ranga Reddy District, the possession was not delivered to the petitioners and the same was also intimated to them; since the land in Sy.No.27 of Kowkur Village was already handed over to the Housing Board for construction of houses under "Rajiv Gruha Kalpa Scheme", the relief sought for by the petitioners in this writ petition cannot be considered.

Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue.

Learned Assistant Government Pleader for Revenue submits that the Government of Telangana, vide G.O.Ms.No.8, dated 26.09.2015, G.O.Ms.No.10, dated 15.10.2015 and G.O.Ms.No.12, dated 26.11.2015, have issued guidelines regarding selection of

Gram Panchayaths/Urban Local Bodies and sanction of two bed room houses, its pattern, design, subsidy, unit cost, administrative sanction, technical sanction and execution. The scheme of two bed room houses has already started in both Hyderabad G.H.M.C area for weaker section people and also to the eligible local villagers within the respective Mandals in Ranga Reddy District. In some of the allotted lands, the tender work has been finalised and the construction activity has also been taken up for construction of two bed room houses (2BHK) and that the petitioners can apply for allotment of the same in their respective areas and that the authorities would consider the same in accordance with the relevant G.Os.

In view of the facts and circumstances of the case and especially in view of the submission made by the learned Assistant Government Pleader for Revenue, the writ petition is disposed of permitting the petitioners to apply for allotment of two bed room houses (2BHK) under the Group Housing Programme "Rajiv Gruha Kalpa", in their respective areas, in accordance with the relevant G.Os and on filing such applications, the respondents are directed to consider the same in accordance with law.

With the above direction, the writ petition is disposed of. No order as to costs.

Miscellaneous petitions pending if any, in the writ petition shall stand closed.
