HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.554 of 2017 ORDER:

Apprehending that petitioner is sought to be dispossessed from the premises bearing D.No.6/983 (Old), new W.M.C.No.6-619, this writ petition is filed. 2.

When the matter is taken up for consideration, learned standing counsel representing 2nd respondent Corporation submits that as of now, there is no proposal with the Municipal Corporation to dispossess the petitioner from the subject property and if as and when Municipal Corporation requires property of the petitioner, due procedure will be followed. She further submits that illegal construction is being made. Counsel for petitioner denies of making any illegal construction.

Writ petition is disposed of recording the statement of the learned standing counsel that Municipal Corporation is not taking possession of petitioner's property for the purpose of widening of road. However, liberty is granted to the Municipal Corporation to follow due process if there is any unauthorized/illegal construction made by the petitioner in the subject property.
