HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 28979 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the Writ Petition is disposed of at the admission stage itself.

The present Writ Petition came to be filed seeking to declare the action of the second respondent in not issuing pattadar pass books and title deeds to the petitioner in respect of the land in Survey No.56 admeasuring Acs.18.22 guntas situated at Chinna Hyderabad Village, Zaheerabad Mandal, Medak District, by considering the petitioner's Form-VI (A) application and representation dated 31.07.2014 filed under the provisions of A.P.Rights in Land and Pattadar Passbooks Act, 1971 and Rules made there under as illegal and arbitrary and consequently direct the second respondent to forthwith issue pattadar pass books and title deeds to the petitioners.

The facts in issue are as under:

The father of the petitioner late Rachi Reddy is the absolute owner and possessor of the land admeasuring Acs.18.22 guntas situated at Chinna Hyderabad Village, Zaheerabad Mandal, Medak District.

After considering the protected tenancy rights, the Revenue Divisional Officer issued 38-E certificate under the provisions of A.P.(Telangana Area) Tenancy and Agricultural Lands Act, 1950 in favour of the father of the petitioner. During the life time of the father of the petitioner, he cultivated the said land; raised dry crops and later he was issued with pattadar passbooks and title deeds. On 15.08.1993, the father of the petitioner died and since then the petitioner has been cultivating the said land. It is stated that on 31.07.2014, the petitioner submitted Form VI A application and also made a representation to the second respondent intimating the acquisition of rights over the said property and seeking mutation of his name in revenue records by issuing pattadar passbooks and title deeds. The second respondent failed to initiate any action on the said 6 A application dated 31.07.2014 till date, inspite of frequent persuasions made by the petitioner. Hence the Writ Petition. Though various grounds are raised in the Writ Petition, learned counsel for

the petitioner restricts his prayer seeking a direction to the second respondent to pass orders on the representation dated 31.07.2014 and also in Form-6A made by the petitioner before the Tahsildar.

Learned Government Pleader for Revenue submits that if really, any representation is made and if the same is not considered, a direction may be given to the respondents to pass orders in the above said representations, in accordance with law.

Without going into merits of the case and having regard to the circumstances stated above, the present Writ Petition is disposed of directing the second respondent to consider the application made by the petitioner in respect of the land in Survey No.56, admeasuring Acs.18.22 guntas situated at Chinna Hyderabad Village, Zaheerabad Mandal, Medak District, within six (06) weeks from the date of receipt of a copy of this order, in accordance with law. No costs. Consequently, the Miscellaneous Petitions, if any, pending in this Writ Petition shall also stand closed.
