THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.6218 OF 2017 ORDER:
Heard learned counsel for the petitioners and also the learned Public Prosecutor, representing the 1st respondent - State, before ordering notice to the 2nd respondent and perused the grounds urged in the quash petition and the other material on record.

The issue in the present case is squarely covered by the order of this Court in Gaddameedi Nagamani Vs. State of Telangana and others1, observing that there is an effective remedy of appeal under Section 29 of the Protection of Women from Domestic Violence Act, 2005 (herein after, 'the Act') to impugn the cognizance taken even, hence, this criminal petition is disposed of, giving liberty to the petitioner to file appeal under Section 29 of the Act before the Court of Sessions, within one week from the date of receipt of copy of the order and the learned Sessions Judge, shall entertain the appeal, if filed, without insisting for period of limitation, if otherwise in order.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
