THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Writ Petition No.16462 of 2016 ORDER :

Heard the learned counsel for the petitioner and the learned Government Pleader for Home.

The grievance of the petitioner is that the petitioner is the owner of the land to an extent of Ac.9.74 cents, situated at Malakondapuram Village, Pamuru Mandal, Prakasam District and on 25-12-2014, the 6th Respondent approached him to purchase his land and paid Rs.1,00,000/- as a token amount as an advance and again in December, 2015, the 6th Respondent came and demanded the petitioner to pay back Rs.1,00,000/- as he was not willing to purchase the land of the petitioner and on that, the petitioner requested him for time to repay the amount, but the 6th Respondent forced the petitioner and obtained signatures on some blank cheques and went away.

After sometime, on the strength of the cheques, the 6th Respondent approached the 3rd Respondent-Police, Kanigiri in respect of his claim and the 3rd Respondent instructed the 5th Respondent to summon the petitioner to the Police Station for settlement. In spite of the petitioner's submission that it is purely a civil dispute, the Police are threatening the petitioner to settle the matter with the 6th respondent and trying to implicate him in a false case. Hence, the petitioner seeks direction to Respondent Nos.3 to 5 not to call the petitioner to the Police Station and harass him.

The learned Government Pleader obtained written instructions from the Assistant Sub-Inspector of Police, Kanigiri Police Station, as per which, they have not threatened the petitioner for settlement of the dispute with the 6th Respondent and the said allegation is false and they are only discharging their lawful duties. The learned Government Pleader submitted that as per this information, no case is pending against the petitioner as on date.

In these circumstances, the Respondent Nos.3 to 5 are directed not to cause any sort of harassment to the petitioner by calling the petitioner to the Police Station, unless any case is registered against him showing his involvement in any crime. The Writ Petition is disposed of accordingly. No order as to costs.

Consequently, Miscellaneous Petitions pending, if any, in the Writ petition shall stand closed.
