ORDER

This writ petition is filed seeking the following relief: "to issue writ or direction preferably writ of Mandamus declaring the proceedings issued by respondent in Ref No.SRP/RK5/WO/2006/1564 dt 12.4.2006 as illegal, arbitrary, contrary to record and violative of principles of natural justice and consequently direct the respondent to continue the petitioner as usual on the basis of entry made in the P.F account and pass such other or further orders as this Hon'ble Court deems fit and proper in the circumstances of the case."

Learned counsel appearing for the petitioner submits that while admitting the writ petition, no interim order was granted to continue the petitioner as per his actual date of birth; that during pendency of this writ petition, the petitioner had retired from service; that the petitioner may be permitted to submit a representation for release of his terminal benefits; and that appropriate orders be passed directing the respondents to release the terminal benefits. Having regard to the said submission, this Writ Petition is disposed of directing the petitioner to submit a representation to the respondents within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the respondents shall consider the same and pass appropriate orders for release of terminal

benefits, if not already released, in accordance with law, within a period of four weeks thereafter. No costs. Miscellaneous petitions, if any, pending shall stand closed.
