HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner claims to be the owner of land to an extent of 1585.33 square meters in Sy.No.225/P of Alwal village, MalkajgiriMedchal district. He has filed application under Section 6 of Urban Land (Ceiling & Regulation) Act, 1976 (Act, 1976). Order under Section 8(4) of the Act, 1976 was passed determining the retainable area of 1585.33 square meters and surplus area out of total extent of 9375 square meters in the above survey number. The retainable area and surplus area is clearly delineated in a plan annexed to the proceedings under Section 8(4) of the Act, 1976. Aggrieved by the said proceedings, petitioner filed W.P.No.10130 of 2017 before this Court. While so, contending that the retainable area shown in a plan is in not contiguous, but was separated over five places in small bits rendering it unfit for utilization to the declarent and, therefore, he made representation on 25.03.2019 requesting to consider the demarcation of retainable area in one composite block. Alleging inaction on the said representation, this Writ Petition is filed.

With the consent of learned counsel for petitioner and the learned Assistant Government Pleader, Writ Petition is disposed of, without expressing any opinion on merits, directing the District Collector (Urban Land Ceiling), Medchal-Malkajgiri District, to examine the claim of petitioner as ventilated in the representation dated 25.03.2019 with reference to his request to consolidate the retainable area in one composite block and pass appropriate orders

within a period of six weeks from the date of receipt of copy of this order.

Writ Petition is accordingly disposed of.
