This revision is filed under Section 397 and 401 Cr.P.C. challenging the docket order, dated 16.02.2018 in Crl.M.P.No.243 of 2018 in F.I.R. No.1 of 2018 on the file of the Addl. Judl. Magistrate of I Class, Bodhan.

2. Heard learned counsel for the petitioner, learned Assistant Public Prosecutor for the State and perused the record.

As per the material placed on record, earlier there are two criminal cases, where the petitioner is being prosecuted for the offence punishable under Section 379 IPC. This is third one. It is alleged that the petitioner was found transporting the sand illegally in the same vehicle. If the vehicle is released, there is possibility of committing similar offences. The Court below had dealt with all the contentions put forth by the petitioner. There is no miscarriage of justice. The revision is devoid of merit and is liable to be dismissed.

Accordingly, the Criminal Revision Case is dismissed. Miscellaneous petitions, if any pending in this revision shall stand closed.
