THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO WRI T PETI TI ON No.23383 of 2017 ORDER:

This writ petition is filed by the petitioner unit claiming exemption from obtaining license under the Telangana Wood Based Industries (Regulations) Rules, 2016 and challenging seizure, dated 29.06.2017, whereby the respondents seized the machinery of the petitioner unit. 2.

The third respondent filed a counter-affidavit on behalf of all the respondents. It is noticed by this Court that the application of the aforementioned Rules is in dispute in the present writ petition. However, the learned counsel for the petitioner unit has submitted that the machinery of the petitioner unit was seized without issuing any notice. In the circumstances, this Court feels it appropriate that the respondents shall issue appropriate notice to the petitioner unit pointing out the violation of the aforementioned Rules, if any, and give sufficient time to it for submitting explanation. The respondents shall pass a reasoned order after considering the explanation submitted by the petitioner unit. 4.

Accordingly, the seized machinery shall be released to the petitioner unit, but the petitioner unit shall not operate the unit till a final order is passed by the respondents. The respondents shall complete the entire process within a period of three weeks from the date of receipt of a copy of this order.

Subject to the above directions, the Writ Petition is disposed of. It is needless to observe that the respondents shall issue notice to the petitioner unit immediately after receipt of the present order and it is open

ARLR,J W.P.No.23383 of 2017 17.08.2017 to the petitioner unit to submit its explanation within a period of one week from the date of receipt of such notice.

As a sequel to disposal of the writ petition, W.P.M.P.No.28881 of 2017 filed by the petitioner for interim relief shall stand disposed of as infructuous.
