When the matter is listed on 24.11.2016 before this Court, learned counsel for the petitioner sought time for filing reply. Again when the matter is listed on 09.12.2016, time was sought. Thereafter, when the matter is listed on 30.12.2016, there is no appearance on behalf of the petitioner and this Court ordered to post the matter under the caption 'for dismissal'. When the matter is listed on 06.01.2017 under the said caption, learned counsel for the petitioner again sought time for filing reply and this Court directed to list the matter on 20.01.2017, as a last chance.

Even when the matter is listed on 20.01.2017 i.e. today, there is no appearance on behalf of the petitioner in the morning and afternoon sessions, which goes to show that the petitioner is not evincing any interest in prosecuting the matter diligently.

Hence, this petition is dismissed for non prosecution. No order as to costs.
