THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.13844 OF 2017 ORDER:

This writ petition is filed challenging the action of the respondents in keeping the petitioner's flat bearing No.401 in 4th floor of Kranthi Residency, Puppalaguda Village, Rajendra Nagar Mandal, Cyberabad, in their custody.

Learned Government Pleader, on the basis of the written instructions, submits that on the complaint of the watchman of the said flats, Narsingi police registered crime No.467 of 2016, on 23.08.2016 and the investigation was taken up. The complaint related to the death of one Parvathaneni Rekha in the said residence. The accused/husband was arrested on 29.08.2016 and he was sent to judicial custody. So far as the seizure of flat is concerned, the police denied any seizure of the subject flat and hence, the question of handing over the flat to the petitioner does not arise.

In view of the same, the cause of action in the writ petition does not survive and it is open to the petitioner to take appropriate proceedings in accordance with law.
