THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.11335 OF 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed requesting to declare the inaction of respondent Nos.2 and 3 in taking action on the complaint, dated 10.03.2018, made by the petitioner against respondent Nos.4 to 7, as illegal, arbitrary and contrary to the provisions of the Indian Constitution and principles of natural justice.

I have heard the submissions of Sri M. Suryanarayana, learned counsel appearing for the petitioner, and of the learned Government Pleader for Home (AP) appearing for respondent Nos.1 to 3. I have perused the material record. 3.

Learned counsel for the petitioner would submit that the unofficial respondents are trying to forcefully evict the petitioner from the property and that when a complaint is lodged against such high-handed action of unofficial respondents, no action so far has been taken by the police officer concerned and hence, the Writ Petition is filed.

Learned Government Pleader for Home (AP), on written instructions, a copy of which is placed on record, would submit that on receipt of the complaint, dated 10.03.2018, an entry was made in the General Diary of the police station and that a preliminary enquiry was also made and that the said investigation revealed that the matter is purely civil in nature and that the said fact was informed to the petitioner/complainant and the petitioner

was advised to approach a civil Court and the petitioner endorsed receipt of the said information.

In reply, learned counsel for the petitioner would submit that the Writ Petition may be disposed of reserving liberty to the petitioner to proceed in accordance with the procedure established by law and seek appropriate remedies, which the law permits. 6.

Recording the submissions, the Writ Petition is disposed of reserving liberty to the petitioner as sought for. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.

There shall be no order as to costs.
