ORAL ORDER:

Heard learned counsel for petitioner and learned Government Pleader for Revenue.

Petitioner claims to have purchased land to an extent of Ac.6.29 guntas in Survey No. 51, Shamshabad village and mandal, Ranga Reddy district from Sri Habeeb Hussain Alattas, Sri Habeen Zain Alattas and presented the sale document dated 13.2.2019 for registration before the Sub Registrar, Shamshabad. The Sub Registrar, vide endorsement P No. 138/2019 dated 26.3.2019 refused to register the document on the ground that the subject property is included in the list of prohibited properties under Section 22 A of the Registration Act, 1908. In this writ petition, petitioner challenges the said decision. 3.

Learned counsel for petitioner placed reliance on correspondence entered between Tahsildar and District Collector dated 16.1.2019 saying that issue of deletion is pending with the District Collector and therefore the Sub Registrar could not register the documents.

Suffice to note that so long as property is included in the list of prohibited properties, the objection of registering authority cannot be held as illegal.

However, learned counsel for petitioner and learned Government Pleader for Revenue have agreed for disposal of the writ petition with a direction to consider the application made by the predecessor of petitioner to District Collector for deletion of the property from the list of prohibited properties.

In the circumstances, without expression of opinion on the merits of the matter, if the application stated to have been presented by Sri K Ramana Reddy dated 29.5.2019 is still pending and no decision is made, the District Collector is directed to process and dispose of the same expeditiously in accordance with law and communicate the decision to the petitioner.
