Heard learned counsel for the petitioner, learned Government Pleader for respondents 1 and 2, Sri N. Praveen Kumar, learned Standing Counsel for respondent No.3 and Sri Domnic Fernandes, learned Standing counsel for respondent No.4.

Petitioner was granted licence to establish and run petroleum retail outlet by the Indian Oil Corporation on the road leading from Karimnagar to Peddapalli. Petitioner obtained necessary permissions and thereafter submitted building permission application on 08.10.2018 to grant permission to construct small building for establishment of the petroleum outlet. On 23.05.2019 petitioner submitted representation alleging that even though inspection was conducted and all verifications were made, so far building permission is not granted. Alleging inaction, this writ petition is filed. 3.

Though in the representation dated 23.05.2019 petitioner sought to refer plausible reason for not granting permission, since no reply is furnished to the application submitted by petitioner, no opinion is expressed on this aspect. However, it is open to the petitioner to submit all the relevant documents in support of her claim to the Municipality. Since building permission application is pending for long time, the Commissioner, Municipal Office, Sultanabad is directed to process the same and take appropriate decision as warranted by

- 3 - law, within two weeks from the date of receipt of copy of this order. If the Commissioner is not accepting the application for grant of building permission he shall assign due reasons in support of the decision and communicate the same to the petitioner.
