ORAL ORDER:

Petitioner is plaintiff. He filed I A No. 148 of 2016 praying to appoint Advocate Commissioner for demarcation and fixation of boundaries in respect of land in Survey No. 88, Lashkar Singaram village, Hanamakonda mandal by noting down the physical features of Survey No. 88/A. The trial Court noticed that no mention was made in respect of total extent of land in of Survey No.88 and 88/A; that the suit was filed for declaration in respect of agricultural land admeasuring Ac.0.14 guntas in Survey No. 88/A, whereas the persons who are impleaded as defendants claim their property in Survey No.87. The persons whose lands are situated in survey No. 88 are not defendants and no claim is made against them. Therefore, trial Court refused to grant the relief prayer by the petitioner. The trial Court also noticed that earlier petitioner got the suit land surveyed.

Having heard the learned counsel for petitioner and on perusal of the material on record, I see no error in the decision arrived at by the trial Court warranting interference of this Court.

At this stage, learned counsel for petitioner submitted that he may be granted liberty to implead the owners of property in Survey No.88 as defendants. No opinion can be expressed at this stage nor such relief can be granted straight-away. It is always open to the petitioner to array such persons who are necessary and appropriate parties for proper adjudication of the suit. Accordingly, revision petition is dismissed. No costs.
