THE HON'BLE SMT JUSTICE T.RAJANI CRIMINAL PETITION NO.7750 OF 2011 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in Cr. No.218 of 2010 on the file of the Station House of Officer, Yemmiganur Town Police Station, Kurnool District.

Heard the learned counsel for the petitioners and the learned Public Prosecutor appearing for the 1st respondent. None appears for the 2nd respondent in spite of notice served on him.

Learned counsel for the petitioners submits that it is absolutely a civil dispute and in order to avoid execution of sale deed in favour of the accused, the complainant foisted a false case against them.

A perusal of the complaint shows that specific allegations are made against the accused that they attacked the complainant. The genesis of the allegations maybe a civil dispute, but it cannot be said that a civil dispute does not lead to criminal offence. The same may be adjudged only after adducing the evidence during trial. It cannot be said that it is a fit case to quash the proceedings. It is also contended that there is no mention of the abuses made in the name of the caste of the complainant. A complaint cannot be considered as encyclopedia of all the events that have occurred. It is nevertheless stated that the accused abused the complainant in the name of his caste. 5.

Hence, with the above observations, this Court is inclined to dismiss the petition and accordingly, the petition is dismissed. The petitioners can file a discharge petition, if

they so choose. Miscellaneous petitions, if any pending, in this petition shall stand closed.
