HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.6739 OF 2008 ORDER:

This writ petition is filed challenging the Sale Notice dated 19.02.2008 in DEC-465, CEP No.195/07-08 issued by the 1st respondent-The Deputy Registrar of Cooperative Societies, Rajahmundry, East Godavari District. The auction was proposed to be held for recovery of Rs.4,91,629/- with interest from the petitioner.

When the matter came up for admission on 28.03.2008, this Court granted interim stay on condition of petitioner depositing half of the outstanding amount within a period of six weeks from 28.03.2008. Now, the learned counsel for the 2nd respondent submits that in November-2012, the petitioner approached the Bank and paid the entire loan amount and also taken back the sale deed which was mortgaged with the Bank. In that view of the matter, this writ petition does not survive.

Recording the said submission, the writ petition is dismissed as infructuous. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall also stand closed.
